The agreements that govern any work Martinez Performance & Auto Repair performs on your vehicle. By submitting a service request, dropping off a vehicle, or approving an estimate, you agree to all terms below. Read carefully.
1. Diagnostic Service Terms
Service Purpose
Vehicle is brought in for diagnostic evaluation to identify the cause of a concern — warning lights, abnormal operation, or system malfunction. This service is intended to provide accurate information and direction for proper repair.
Diagnostic Process
The vehicle diagnostic service includes, but is not limited to:
- Scanning vehicle systems for fault codes and data
- Visual inspection of related components
- Performing system-specific tests based on symptoms
- Test driving the vehicle (when required)
- Inspecting, removing, and reinstalling components as needed for access or testing
This process is necessary to accurately identify the root cause of the issue — not just the symptoms.
Fuel Requirement
Vehicle must have sufficient fuel to allow proper testing and test driving. If fuel level is low, testing may be limited or delayed. A $30 fuel service charge may apply if fuel is required to complete diagnostics.
Important Diagnostic Disclosure
Read carefully: Diagnostic testing may place the system under normal or increased operating conditions in order to identify faults. Due to this, existing issues may become more noticeable or worsen during testing — and a failing component may fail completely during the diagnostic process. In some cases, the vehicle may become undrivable after testing due to the pre-existing condition of the system. These outcomes are not caused by the diagnosis itself but are the result of pre-existing conditions being exposed.
Authorization for Testing
By approving this service, customer authorizes Martinez Performance & Auto Repair to:
- Scan and analyze vehicle systems
- Perform necessary inspections and testing procedures
- Test drive the vehicle under safe and controlled conditions
- Remove and reinstall components required for proper diagnosis
Limitations of Diagnostic
- Diagnostic service is an information-gathering process only and does not include any repairs or temporary fixes.
- May require additional diagnostic time if multiple issues are present.
- May require further disassembly or advanced testing to fully confirm the issue.
Recommendations & Next Steps
After diagnostic completion, a repair estimate will be provided based on findings. Additional repairs or testing may be recommended. No repairs will be performed without customer approval.
Billing & Application
- Diagnostic fee: $250 standard / $300 electrical
- If customer approves recommended repairs → diagnostic fee is applied toward the repair cost
- If customer declines repairs → diagnostic fee remains due in full
Terms & Liability Acknowledgment
By approving this diagnostic service, customer understands and agrees:
- This service identifies issues but does not repair them
- Martinez Performance & Auto Repair is not responsible for pre-existing conditions that worsen or fail during testing
- Martinez Performance & Auto Repair is only responsible for the diagnostic performed — not for underlying failures or consequential damage
- Vehicle condition prior to diagnostic may limit results or require additional work
- Removal and testing of components may expose worn or failing parts
Customer Acknowledgment
Customer has been informed of all diagnostic procedures, risks, fuel requirements, and terms. Customer authorizes the diagnostic service and accepts that findings may require immediate repair and that the vehicle may not be in drivable condition after testing.
2. Estimate Terms & Conditions
01. Body & Paint Condition Disclaimer
Martinez Performance & Auto Repair is not responsible for body or paint condition of the vehicle. Customers must take photos/videos of the vehicle (all sides) at drop-off, including date and time, as proof of condition. Vehicles dropped off before or after business hours are left entirely at customer's risk regarding body, paint, and mechanical condition.
02. Personal Belongings
Martinez Performance & Auto Repair is not responsible for any personal or valuable items left inside the vehicle. Customers must remove all valuables prior to drop-off.
03. Estimate Accuracy & Changes
All estimates are subject to change. Once repairs begin and components are disassembled, additional issues may be discovered, which can affect parts and total cost. Martinez Performance & Auto Repair will make every effort to honor the original labor rate, but parts and additional labor may change based on findings.
04. Authorization for Repairs
Customer approval via text message, phone call, email, or signature (in person or electronic) constitutes full authorization to proceed with repairs and acceptance of these terms.
05. Diagnostic Requirement & Warranty Eligibility
To qualify for any warranty through Martinez Performance & Auto Repair, a diagnostic must be performed by Martinez Performance & Auto Repair. Repairs requested based on another shop's diagnosis carry NO WARRANTY and are not guaranteed to resolve the issue.
06. Warranty Policy
- New parts (provided by us): 1-year / 12,000-mile warranty
- Used parts (provided by us): 30-day warranty
- Customer-supplied parts (new or used): NO WARRANTY on parts or labor
- Custom or tuned vehicles: NO WARRANTY on parts or labor
07. Warranty Limitations
Martinez Performance & Auto Repair is only responsible for the specific repairs performed. We are not responsible for pre-existing issues, hidden damage, or consequential failures. Example: Repairing a cooling system leak does not make Martinez Performance & Auto Repair responsible for engine damage (e.g., head gasket failure) caused prior to repair.
08. Maintenance Services Disclaimer
Maintenance is preventative, not curative. Maintenance services (oil change, fluid service, etc.) are preventative only and do not guarantee resolution of mechanical issues. We will not accept mechanical problems disguised as maintenance requests.
09. Completion Time
Due to the nature of automotive repairs, completion times are estimates only and are not guaranteed.
10. Storage Fees
Vehicles must be picked up within 3 days after completion notification. After that, a $50 per day storage fee will apply.
11. Payment Terms
Full payment is due upon completion. All credit card payments are subject to a 3% processing fee.
12. Test Drive Authorization & Liability
By leaving the vehicle, customer authorizes Martinez Performance & Auto Repair staff to operate, test drive, scan, and move the vehicle for diagnostic and verification purposes. Customer acknowledges the inherent risks associated with test driving. If vehicle registration is expired, customer still authorizes test driving and Martinez Performance & Auto Repair is not responsible for tickets or related issues.
13. Fuel & Battery Requirement
Vehicle must have at least half a tank of fuel and a properly functioning battery for diagnostics and testing. If fuel is insufficient, a $30 fuel service charge will be applied.
14. Pre-Existing & Electrical Issues
Martinez Performance & Auto Repair is not responsible for pre-existing conditions, including electrical issues, intermittent problems, or unrelated failures.
15. Outside Repairs & Warranty Void
If the vehicle is taken to another repair facility before allowing Martinez Performance & Auto Repair to inspect a concern, any warranty related to previous repairs performed by Martinez Performance & Auto Repair is void.
16. Final Inspection & Customer Satisfaction
Before payment, customer will have the opportunity to:
- Inspect replaced parts
- Review photos/videos of repairs
- Test drive the vehicle
Any concerns must be reported before payment and before leaving the premises. Payment and/or signature confirms full satisfaction and acceptance of the repair.
17. After Payment Liability
After payment and vehicle release, Martinez Performance & Auto Repair is not responsible for dissatisfaction claims or issues not reported prior to departure.
18. Acts of God / Uncontrollable Events
Martinez Performance & Auto Repair is not responsible for damages caused by natural disasters, including but not limited to fire, flood, theft, or other uncontrollable events.
Customer Acknowledgment
By approving the estimate provided by Martinez Performance & Auto Repair, the customer confirms they have read, understood, and agreed to all terms and conditions listed above and authorizes Martinez Performance & Auto Repair to perform the requested services.
3. After-Repair Customer Acknowledgment & Vehicle Acceptance
Customer confirms that upon completion of the repair, the vehicle was presented for final inspection. Customer acknowledges and confirms the following:
- Customer has visually inspected the vehicle after repair and confirms it is in acceptable condition.
- Customer has been shown old and new parts, and is satisfied with the proof of repair, including photos, videos, or physical evidence provided by Martinez Performance & Auto Repair.
- Customer performed a test drive (or was offered the opportunity to do so) and confirms that the vehicle is operating properly.
- Customer confirms that the original concern has been resolved 100% to their satisfaction at the time of delivery.
- Customer states they have no further questions, concerns, or complaints regarding the repair performed.
Parts & Disposal Authorization
- Customer authorizes Martinez Performance & Auto Repair to dispose of all replaced parts unless otherwise requested prior to vehicle release.
- Customer understands that failure to request old parts before departure results in automatic disposal.
Vehicle Condition Acknowledgment
- Customer confirms there are no new damages to body, paint, or interior.
- Customer understands that Martinez Performance & Auto Repair is not responsible for pre-existing damage or conditions not related to the repair performed.
Warranty & Liability Disclosure
- Warranty applies only to the specific parts replaced and services performed.
- If used parts were installed, they carry a 30-day warranty.
- If customer-supplied parts were used, there is NO WARRANTY on parts or labor.
- Martinez Performance & Auto Repair is not responsible for pre-existing issues, hidden damage, or future failures unrelated to the repair performed.
- Any additional issues that arise after repair are considered separate and may require additional diagnostic and repair charges.
Final Payment & Legal Acceptance
- Customer understands that full payment is due upon completion of repairs prior to vehicle release.
- Customer agrees that payment, signature, or vehicle pickup constitutes full acceptance of all repairs performed, charges applied, and terms listed in this document.
- Customer acknowledges that no disputes or claims remain open regarding the repair at the time of vehicle delivery.
- Customer agrees that any concerns not addressed at the time of pickup must be handled as a new inspection or diagnostic, subject to applicable fees.
Limitation of Liability Confirmation
- Martinez Performance & Auto Repair is only responsible for the specific repairs performed on this vehicle.
- Martinez Performance & Auto Repair is not liable for any pre-existing conditions, unrelated failures, or consequential damages that may occur after the repair.
- Customer understands that automotive repairs do not guarantee prevention of future failures in other components or systems.
4. SMS Messaging Terms
Program Name: Martinez Performance & Auto Repair Service Updates
Effective Date: May 19, 2026
01. Program Description
By opting in to receive SMS messages from Martinez Performance & Auto Repair, you agree to receive recurring text messages regarding your vehicle service — including estimates, repair status updates, appointment confirmations, account alerts, and other transactional information related to work we are performing for you. Message frequency may vary depending on the status and progress of your service.
02. Opt-In
You may opt in by providing your mobile number when you request a quote, drop off a vehicle, or sign up through our website, by phone, by text, or in person at our shop. By providing your mobile number and confirming opt-in, you consent to receive SMS messages from Martinez Performance & Auto Repair.
03. Opt-Out
You can cancel the SMS service at any time. Just reply STOP to any text message we send you. After you send the SMS message "STOP," we will send you a reply to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

07. Carriers
Carriers are not liable for delayed or undelivered messages.
